DATAP · LEGAL
Terms of service
Version 2026-09-21 · Published 21 September 2026
Datap provides the platform. The identified seller supplies and licenses the dataset. These terms explain the separate responsibilities of Datap, sellers and buyers.
1. Who operates Datap
Datap is operated by 21 Holdings Limited, registered in England and Wales (company number 10815109). Registered office: 167–169 Great Portland Street, London, England, W1W 5PF. Write to this address, marked “Datap — legal/privacy”, or use private support in Settings. You do not need an account to write to us.
“Datap”, “we” and “us” mean 21 Holdings Limited. “Seller” means the person or business identified as supplying a dataset. “Buyer” means the person or business acquiring its licence. “Dataset” includes a subset, snapshot and authorised updates. An acquisition may be free or paid.
These terms cover our website, account, API, MCP connection and delivery services. Paid provisions apply only where the feature is enabled and you approve a purchase. Publishing these terms does not activate billing or authorise a charge.
2. Your contracts: platform and dataset
Your agreement with Datap covers platform access, hosting, technical delivery, account management and platform support. Your dataset agreement is with the seller identified before approval. It consists of the accepted listing, seller licence, quote or subscription terms and the buyer–seller provisions here. The seller is responsible for lawful supply, description, licensing and contractual fulfilment.
The seller is the merchant of record for its paid dataset: the business selling to you and receiving payment through its own connected Stripe account. Datap facilitates the transaction and takes a platform fee. Our checkout, servers and support service do not make Datap the dataset seller.
Sellers appoint Datap as their disclosed, limited agent to present approved offers, record acceptance, arrange Stripe payments, host and deliver licensed data, administer subscriptions and handle support and refunds within the seller’s authority and applicable law. The seller retains its supply obligations. Datap remains responsible for its own services, actions and legal duties.
The seller’s legal business identity and required contact information must be available before purchase and on transaction documents. Public aliases are reputation labels, not the contracting identity. Do not approve an acquisition if its seller or licence is unclear. Tax law may separately require Datap to collect or account for tax; payment roles do not override tax law.
The accepted quote controls exact prices and access periods. The seller licence controls permitted use. The seller data-processing agreement controls processing on a seller’s behalf. None can remove mandatory statutory rights. Revised terms do not retrospectively replace an accepted purchase.
3. Accounts and authority
You must be at least 18 and authorised to enter the relevant agreement. If you act for a business, it is the contracting user and you confirm your authority to bind it. Keep information accurate, protect credentials and report unauthorised access promptly. Verified guest purchases carry the same purchase obligations.
We may require verification, investigate misuse or refuse activities we cannot lawfully support. Stripe separately determines onboarding and payment requirements. A completed account profile does not guarantee payment eligibility.
4. Buying and using datasets
A buyer makes an offer by approving the identified seller, licence and quote. The dataset contract forms when the platform confirms acceptance on the seller’s behalf after any required payment succeeds. Failed payments and expired quotes do not authorise replacement purchases. Keep your confirmation and licence.
You obtain the specified licence, not ownership of the underlying information or unrestricted rights to personal data. Follow its purposes, recipients, territories and duration. Redistribution, resale, publication and model training require permission under the licence and applicable law. Agent access does not expand these rights.
The seller must supply data materially matching its description and honour promised access, updates and remedies. Check schema, coverage, sources, limitations and refresh cadence. Samples contain only the approved sample fields. “Live” describes the stated refresh arrangement, not a guarantee of uninterrupted real-time data.
Buyers are responsible for their subsequent use, security, lawful basis and applicable notices. Lawful collection by a seller does not make every buyer use lawful. A licence is not permission for unlawful marketing, surveillance or decisions about individuals.
5. Prices, recurring billing and agents
The offer must disclose currency, subtotal, tax, total, pricing units, access period, any recurring base fee, included usage, update prices and spending limit before approval. Separate sellers may produce separate charges, despite one Datap account. Tax and invoice treatment follows the law applicable to the transaction.
A one-off approval covers that quote only. Subscription approval authorises the identified seller’s disclosed recurring fees and delivered usage within agreed limits. Base fees are charged in advance and delivered usage may be charged in arrears. An amount above the applicable approval or spending cap requires fresh approval. Saving a card, verifying email or connecting an agent does not approve a purchase.
Unless the accepted offer says otherwise, subscriptions renew monthly on the recorded anniversary. Cancel before renewal through subscription management to stop future renewal and delivery. Pausing delivery does not cancel the base fee. Cancellation does not erase lawful charges for delivered usage; a final invoice may follow. Earlier acquisitions retain the rights and retention limits of their licence. Failed payments may pause further billable delivery; bank authentication may be required for recovery.
Within a seller’s dataset lineage, previously acquired record versions are excluded from another acquisition charge under the offer’s deduplication rules. This is not a guarantee against overlap across sellers or separately disclosed products. New information or changed records are chargeable only under the accepted update policy. Free corrections and paid updates must be distinguished; buyers can decline optional paid updates. Replacing a stored record does not itself authorise a charge.
Stripe stores payment credentials. With the buyer’s authorisation, supported saved cards and necessary billing details can be associated with seller-specific payment records. Agent permissions and approval links are limited in scope. Protect them and control the authority you grant. Responsibility for authorised actions remains subject to statutory protections for unauthorised payments.
6. Seller duties and delivery instructions
Sellers must have the rights and lawful basis to collect, hold, advertise, license and disclose their data through Datap to permitted recipients. Public availability alone is insufficient. Sellers must supply accurate source, coverage, freshness, licence and business disclosures, maintain permissions and respond to complaints and rights requests. They are responsible for required notices to people in their datasets, including indirectly collected data, unless a valid exemption actually applies.
Do not upload stolen data, passwords, authentication tokens or unlawfully obtained information. Personal data about children, special-category data, criminal-offence data and similarly sensitive datasets require prior written approval, an appropriate lawful basis and agreed safeguards. General upload access is not that approval.
All fulfilment takes place through Datap’s hosted delivery. External download links and direct delivery cannot substitute for it. Sellers grant the limited rights needed to store, validate, format, filter, deduplicate within their dataset lineage, create authorised exports and deliver the dataset. Before publication, they must record approved fields, public samples, permitted purposes and recipients, geographic restrictions, retention, updates and deletion instructions.
Sellers choose what data to offer and why. Datap can choose technical methods within those instructions. They do not authorise Datap to create profiles by combining different sellers’ personal records, select new purposes for dataset contents or train its own models on them. The seller data-processing agreement governs personal-data processing.
7. Seller fees and payment administration
Unless expressly agreed and recorded otherwise, commission is 20% of the dataset subtotal after discounts, excluding tax, rounded down to the currency’s smallest unit. Stripe deducts the application fee automatically. Where Datap collects transaction tax, that tax is also withheld and accounted for separately from commission. Stripe processing charges are separate and normally charged to the seller’s connected account. Any applicable tax on Datap’s own services must be disclosed separately.
Sellers authorise Datap to administer invoices, credit notes, refunds and proportionate commission/tax reversals through their connected accounts to fulfil purchase terms, correct errors and comply with law. Seller-initiated refunds must be reflected in Datap’s records. The seller retains its refund and supply obligations. Stripe’s terms govern balances, disputes, payouts and payment restrictions.
Fee changes require notice of the rate and effective date. They apply to new offers after that date; existing subscriptions require an explicit recorded change notified to the affected seller before it takes effect. Already approved purchases and frozen billing periods are not repriced. Sellers can stop new business rather than accept future changes, subject to existing obligations.
8. Support, refunds and consumer rights
Contact Datap with the listing/order reference and problem description. We handle technical delivery and billing administration, coordinate the seller’s response and can issue authorised refunds. The seller is responsible for remedies for failure to supply its dataset as agreed. Datap is responsible for remedies arising from its own service failures.
Refunds follow the accepted offer and applicable law. There is no blanket “no refunds” rule for downloaded data. A pending refund is not a completed return of funds. A completed refund may end corresponding licensed access where lawful; any remaining rights and required deletion must be explained. Financial history is retained separately.
Consumers retain mandatory rights concerning descriptions, quality where applicable, reasonable care and skill, remedies and cancellation. Immediate digital supply removes a statutory cancellation right only after the legally required express consent, acknowledgement and confirmation. Accepting these terms or creating an account does not waive it. Neither seller licences nor these terms override consumer rights.
9. Withdrawal, deletion and acceptable use
We may restrict a listing or access on authorised seller instruction, legal requirement, a security or privacy risk, or material breach. Where lawful and practicable, we explain the reason and provide a way to challenge errors. Seller withdrawal does not erase obligations or buyer remedies.
Withdrawal may immediately block access while audited jobs invalidate exports and remove or compact stored contents. Old uploads must not restore deleted records. Downloaded copies cannot be remotely erased; recipients must follow lawful deletion notices and licence obligations. Necessary financial, dispute and compliance records are kept separately.
Do not bypass access controls, impersonate others, misuse credentials, introduce malicious code, or use the platform for unlawful surveillance, discrimination, fraud or harassment. Do not include confidential information in public listings, requests or reviews. We may moderate these surfaces and preserve proportionate evidence of misuse.
10. Our responsibilities and ending access
Datap provides its services with reasonable care and skill. Hosting and delivery are not guarantees of every seller’s data, rights or business outcomes. Each party remains responsible for its own breach, negligence and statutory duties. These terms do not exclude direct processor obligations, joint liability where imposed by law or rights of people whose data is processed.
For business users only, where lawful, Datap is not liable for indirect or consequential loss or loss of anticipated profit, revenue, goodwill or business opportunity. Nothing limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or liability that cannot lawfully be limited. These business exclusions do not apply to consumers or excuse mandatory remedies for Datap’s own failures.
We may suspend or end access for material breach, security risks or legal requirements, giving notice and an opportunity to fix a remediable breach where practicable. You can request account closure through support. Closure does not erase valid payment obligations, accrued rights or legally required retention.
11. Changes and applicable law
We publish the effective version and give reasonable notice of material changes through the service or account contact details. We request agreement where required before applying a change. Changes do not retrospectively alter accepted licences, approved charges or existing claims. The privacy policy explains information practices; it is not blanket consent to processing.
English and Welsh law governs the platform agreement, with business disputes heard in the courts of England and Wales. Consumers retain mandatory protections and rights to proceedings in their home jurisdiction. Seller–buyer agreements follow any law and jurisdiction validly specified in their accepted licence, otherwise England and Wales, subject to mandatory consumer and data-protection protections. If a provision is unenforceable, the rest continues where reasonably possible.
